
New Regulation on Controlled Substances
Since January 1, 2025, the Czech Republic has implemented Act No. 231/2024, which regulates substances with addictive potential.
The legal text divides these substances into three categories:
- Addictive substances
Considered harmful to health; their sale is prohibited.
- Psychomodulatory substances
Classified as compounds without significant risk to public health.
Their sale remains permitted, although under stricter rules.
- New psychoactive substances
Recently introduced substances whose risks are not yet clear. They will be analyzed for two years before being reclassified.
Publication of the official list
On November 11, 2025, the Czech Ministry of Health published the official classification list.
Among the psychomodulatory substances is kratom (Mitragyna speciosa) and its extracts.
In contrast, cannabinoid products with THC ≤1% were not included, meaning their sale remains legal without regulatory changes.
The decision was based on the opinion of the European Commission, which considered that tightening CBD regulation would be incompatible with the EU single market.
New regulated sales system (including kratom)
Starting November 12, 2025, anyone selling psychomodulatory substances must comply with the following requirements:
- Only authorized businesses may sell them.
- Obtaining a special license from the Ministry of Health.
- Applicable administrative fees (see table below).

Additional obligations
- Mandatory labeling.
- Quality and composition control.
- Laboratory testing prior to sale.
- Sale to minors under 18 is prohibited.
- Age verification for online purchases.
- Advertising, samples, and export are prohibited.
Selling without a license carries criminal liability.
