L’emendamento al codice di procedura civile ceco e al codice di esecuzione comporta una riduzione della sanzione per i premi sanitari e previdenziali non pagati dal 1° gennaio 2022.
In data 30 luglio 2021 la Raccolta delle Leggi n. 286/2021 Coll. ha pubblicato una legge che modifica la legge n. 592/1992 Coll., sui premi dell’assicurazione sanitaria pubblica, e la legge n. 589/1992 Coll., sui premi di sicurezza sociale.
Finora, gli interessi di mora nel pagamento dei premi dell’assicurazione sanitaria e della previdenza sociale erano dello 0,05% per ogni giorno di ritardo e quindi del 18,25% all’anno. Dal 1 gennaio 2022 ci sarà una riduzione.
Il contribuente sarà sanzionato con gli interessi legali, che sono dell’8% più il tasso repo fissato dalla Banca nazionale ceca (di seguito “CNB“) per il primo giorno del semestre solare in cui il contribuente ha iniziato a pagare. L’importo degli interessi è nuovamente dedotto dal codice civile, proprio come per gli interessi di mora.
Se la sanzione è stata commessa prima del 1° gennaio 2022, gli interessi restano allo 0,05% al giorno.
Esempio: calcolo degli interessi di mora
Il contribuente deve CZK 10.000 sui premi a partire da luglio 2020. La sanzione per il 2021 è di CZK 5 al giorno (0,05% di CZK 10.000), ovvero un totale di CZK 1.825. Tuttavia, gli interessi di mora per il 2022 saranno di soli 825 CZK (8% + 0,25%).
Tale emendamento unifica il calcolo degli interessi di mora nel pagamento dei premi con il calcolo degli interessi di mora nel pagamento delle imposte. Il calcolo degli interessi di mora è stato rivisto da una recente modifica del Codice Fiscale – dal 1° gennaio 2021, sorge dal 4° giorno successivo alla data di scadenza originaria dell’imposta alla data del suo pagamento. Derivato anche dal Codice Civile, corrisponde annualmente al tasso repo fissato dalla BCN per il primo giorno del semestre solare in cui si è verificato il ritardo, aumentato (dal 2021) di 8 punti percentuali (in precedenza 14 punti).
